If you look at the interpretation of the Written law (sexual law) on medical practice, in Korea, Article 12 (1) of the Medical Law briefly describes it as "the implementation of medical technologies such as medical and premature birth (an act of helping newborn babies) and nursing." Therefore, it is not known in the Written law how far the medical practice is and where the medical practice is not.

It is true that there may be various interpretations regarding the scope of application of the prohibition on unlicensed medical practice under the Medical Act, and it has been applied differently to lawyers who apply the law.

This is a slight variation in most countries' medical legislation, but there is usually no clear explicit definition as above(Countries such as Europe, Japan, and Korea that follow continental law (German law analogy) are almost identical).

​​The Supreme Court of Korea interpreted the following interpretation of this ambiguous legal provision of the Written law.

"Medical practice means the practice of medicine, optometry, prescription, medication, or surgical procedure performed by a qualified person with experience and skills based on medical expertise." 

It also defines "the act of preventing or treating disease and acts that are not performed by medical personnel that may cause health and hygiene harm are defined as medical practices."

To explain this easily, "Incisions , invasive (insertion, injection, acupuncture, etc.), diagnosis, prescription, physical pressure (chiropractic, massage, etc.) drug injection and drug prescription are all medical activities."

On the other hand, it is considered a medical practice to do anything using the expressions of treatment and prescription without doing the above.

According to Article 2, Paragraph 5 of the Public Health Management Act in Korea, "beauty business" is defined as a "business act" that beautifully decorates a customer's appearance by taking care of their face, hair, and skin.

Therefore, cosmetology can be seen in the categories of hair design, hair and scalp care, skin care, makeup, nail care, and art. In the past, consumer goods such as cosmetics accounted for most of the aesthetic market, but since 30 years ago, there has been a recognition that there is a limit to the pursuit of beauty for the human body just by applying it to the skin and grooming it from the outside.  

So the perception that we can truly pursue beauty by improving the functioning of the human body is becoming commonplace.

As a result, products and services that combine beauty and medical fields are creating a big market due to the spread of technology growth of beauty medical devices and the expansion of consumers' consumption capacity, and are showing high growth every year.

Looking at the Aesthetic business field in most countries, simple cosmetic procedures are performed in the skin care process even though they are not dermatology hospitals, and the means of the treatment are clearly performed by using various medical devices such as various laser machines and compression syringes, which we will see below.

According to the definition of the World Health Organization (WHO), health refers to physical, mental, and social well-being. This is a term that focuses on the extension of a healthy life. The concept of health gradually expanded as the times changed, focusing on improving the quality of life.  The umbrella term is "Wellness." Due to the fierce competition in hospitals, hospitals in Korea and many countries are increasingly combining not only the existing medical practices of diagnosis, drug prescription, and surgery, but also various exercise therapy, food therapy, treatment using various medical and non-medical equipment, music, art, and energy therapy. 

In the past, beauty practices consisted of grooming hair or applying cosmetics to the face or skin, and today, it is becoming more common to use various equipment to penetrate various substances into the skin or apply physical force to change the shape of skin tissue.

Therefore, in order to pursue better beauty, it is not possible to be competitive in the beauty industry without doing what medical professionals can do in the medical law, so it is developing into an industry that combines medical care, beauty, and health care.

If you look at Aesthetic's recent sales patterns, you can see that it is making progress as follows. Most advanced Aesthetic centers apply physical force (hand, machinery, instruments) into the human body or inject drugs, chemicals, and other substances. There are a lot of medical devices that are mobilized here. This is against the medical law unless it is done by a medical professional, and it is virtually all illegal.
